By submitting the present form, you will have the possibility to create your personal account on the sustainArt Observatory. Please note that your information will only be accessible to other registered users and not to the general public.
By signing up, you will be required to write a text review on the work of one or more registered artists. Your review/s will be only visible on your personal account page and on the page of the specific artist. Artists will also have the possibility to use your review for their own bibliography.

In addition you will have the possibility to create your own online exhibition. There is no curatorial theme to follow, however only artists registered to the website may take part to online exhibitions. If selected by the panel, online exhibitions will be published for two months on the 10 Artist 10 Online Exhibition section of the website. In addition, online exhibitions may be selected for the gallery/artfair exhibition which will take place at one of the major events of the contemporary art world.

In all of the above cases, you will be notified by email.

Terms of use

AGREEMENT
1) illy sustainArt is an illycaffe spa project. Any reference made to illy sustainArt has to be considered as a reference to illycaffe' spa, Via Flavia 110, Trieste, Italy. 2) By submitting the present material the artist/curator and art critic grants the illy sustainArt Observatory the right to open a personal account with all related services, on behalf of the artist, curator, and art critic. All submitted information will be processed through an editorial process which complies with our editorial policy.
3) The illy sustainArt Observatory is responsible for the website's updates and maintenance. However, it may not be accountable for temporary nor permanent disconnection of the portal.
4) If, at any time, the user's personal account is used in an unlawful or illicit way (according to Italian law) by the user himself/herself or any other third party, the illy sustainArt Observatory will not be responsible under civil nor penal jurisdiction and it will reserve the right to stop the service immediately.
5) If, at any time, information submitted by artists curators and art critics is found to be untrue, the illy sustainArt Observatory reserves the right to close immediately, and with no further notice, the relevant personal account. This also applies if artists curators and/or art critics have been nominated for the offline version of the online exhibition. Their right to exhibit offline as part of any the illy sustainArt Observatory's activities will be revoked.
6) The artist, in accordance with the Italian law, can submit to the illy sustainArt Observatory works that contain personal data (including images depicted or not depicted) of a third party, only by previous consent of the third party. If the artist submit personal data to the illy sustainArt Observatory without previous documented consent of the third party, the personal data of the third party will not be published on the personal account nor elsewhere on the website and their personal profile will be cancelled. The artist can publish in his own personal account data of a third party only by previous consent of the third party itself. If the artist doesn't have the consent of the third party, the illy sustainArt Observatory will reserve the right to stop the service immediately and will not be responsible under civil nor penal jurisdiction.

PROMOTION
7) The artist/ curator and art critic grants the illy sustainArt Observatory the right to use submitted images and text for promotional use on the Internet, and any other promotional material. The material and images uploaded, will not be used for commercial purposes.
8) Registered users may close their personal account at any time, and they may do so by notifying their wish to the editorial team at the following address info@illysustainart.com. Material of unregistered users will not be used by the illy sustainArt Observatory for promotional purposes either through the Internet or any other form in future promotional activities.

COPYRIGHTS
9) The artist, curator, art critic ensures that copyright for all submitted material belongs to him/her, and if shared, will notify the editorial team and provide proof of approval of submission by whoever shares copyright. If this is not provided, content will not be published on the personal account nor elsewhere on the website. All artworks economic rights remain authors' copyrights. Artists declare and guarantees copyright's ownership of artworks that will be uploaded on the website. The artist therefore relieves illy sustainArt Observatory from any illicit use or violation of copyright of third parties.
10) Curators and art critics grant the illy sustainArt Observatory the right to freely use their selection criteria by which they create the online exhibition. They therefore grant the illy sustainArt Observatory unlimited right to publicise and divulgate through the website articles, introductions, reviews written by them and online exhibitions. Curators and art critics relieve illy sustainArt Observatory from any illicit use or violation of copyright of third parties.
11) The illy SustainArt Observatory is responsible for stating on users personal account and in any other section where users work will be published that ‘All artists/curators/art critics retain full copyright of individual works and written texts'. However, it will not be accountable for unlawful use of copyright made by third parties.
12) Curators and art/critic who register to the website and write reviews on one or more registered artists' work grant the specific artist the right to use the written review for bibliographical purposes, as long as the author is credited in all circumstances. Written reviews by registered curators may not be used by the artist in question for commercial purpose without author's authorisation. Reviews written by curators on specific artists will be published both on the author's personal account as well as on the artist's in question personal account.
13) Registered curators/art critics who will create online exhibitions ensure that exhibition concepts are original, have not been previously realised either on the Internet or in off-line edition elsewhere and that concept ideas do not belong to others.

DISCLAIMER
14) Opinions expressed through the illy sustainArt Observatory are those of the author/s and do not express illy sustainArt Observatory's point of view.
15) All registered users relieve illy sustainArt Observatory from any responsibility connected and or deriving from contents, from valuations and comments on the works reproduced and shared through the website.

GOVERNING LAW
16) This agreement shall be agreed upon by both parties and shall be governed upon and interpreted according to Italian Law.
17) All disputes arising out of or deriving from this Terms and Conditions in connection with the determination and assessment of incorrect practices by artists, curators and/or art critics registered to the website, will be resolved by an independent recognised art critic appointed as arbitrator upon agreement by both parties. The arbitration shall comply with law and equity.

Information on protection of privacy (English & Italian)

Information under art. 13 of Italian Legislative Decree 196/03

You are hereby informed that illycaffè S.p.A. (hereinafter also “the Company” or “illycaffè”) will be in possession of some of your personal data, which you may have provided, for the purposes specified below. 
1.	The Company will process the data in manual mode on paper and using IT systems, to allow your registration with the ……………. portal; to enable you to benefit from all the services it contains, specified in the Editorial policy and Terms and Conditions; for all the purposes contained and specified in the Editorial policy and Terms and Conditions, and for all purposes related to the management of the portal and the SustainArt project by illycaffè. 
The Company may also process the data for purposes related to compliance with all statutory obligations and EU regulations and for the assertion or defence of the Company’s rights. 
The only operations carried out on the data by the Company will be those necessary for the pursuance of the purposes specified in the aforesaid notice.
The Company implements specific security measures to prevent the lost of data, illegal or improper use, or unauthorised access. The Company’s processing of the data will be strictly correlated to the purposes stated in this information notice and illycaffè will be also store the data in databases (including IT databases)
The data will be conserved at the offices of illycaffè S.p.A. and at the workplaces of the data processors appointed (as well as on the premises of third parties to whom they are disclosed as specified herein).
2.	The data will be visible in the private area of the portal and the Company will thus disclose them to curators or critics (if you register as an artist) and to other artists and curators and critics (if you register as a curator or critic). Your forename, surname and email and postal addresses will be visible and thus disclosed whether your register as an artist or as a critic or curator. Artists also have the option of displaying additional data containing information, photographs, biographies, etc.
In the event that you register as an artist and the Panel decides to publish your work in the public area or display the work in a real exhibition, some of your data (forename and surname, year of birth, place of residence, ownership of the work) will also be disclosed on the portal www.illysustainArt.org and by means of all other promotional material and media. 
Your name and surname will also be disclosed through the portal and all other promotional material and media if you have registered as a curator or critic and are a curator or critic of a work which is published or included in an exhibition.
Furthermore, illycaffè S.p.A. shall at all times be permitted to disclose the data to public bodies and the police if such disclosure is compulsory, and to lawyers, and to the post office or carriers-forwarding agents if communications or material are dispatched by post.
If necessary, the data may also be processed by (and thus come to the knowledge of, as persons in charge of the data processing) all the persons in charge of the data processing (administrative staff, shareholders, internal and external IT technicians, public relations staff, marketing staff, Information Systems staff, project and project promotion staff, site management staff and legal affairs staff, external legal, IT and quality control consultants, and internal and external envelope filling and mailing staff), appointed by the Company in accordance with the legal requirements, depending on their authorisation levels and profiles. The data may also come to the knowledge of any internal and external data processors (including marketing consulting companies, IT outsourcers which store the data in their servers or perform maintenance on IT systems, companies appointed to manage the project and the website, call centre operator companies, and envelope filling and mailing companies) appointed by the Company. The data processors shall only process the data if necessary for the performance of the tasks assigned to them by the Company, only carrying out on the data the operations necessary for the performance of the said tasks. The external companies/subjects appointed as data processors shall only process the data, directly or through their staff assigned to process the data on behalf of illycaffè, who shall perform the same activities as the said external/companies on behalf of illycaffè.
3.	The provision of the data which appear in bold type in the registration form is necessary to allow processing of your registration and for all the purposes stated in point 1. In the event of failure to provide the data, we will be unable to process your registration and/or your participation in the SustainArt project. The only consequence of failure to provide the data not in bold type in the registration form, and any other data requested (naturally, except for those in bold type in the registration form) will be that these data will not be used (which may be useful for provision of a better service and more effective promotion of the artist); therefore, the provision of these data is optional and failure to provide them will not debar you from registering for the event.
4.	The data controller is illycaffè S.p.A. with registered office at via Flavia 110, Trieste tel. +39.040.3890.111, fax +39.040.3890.490.
5.	The data processor, whom you may contact to exercise your rights under art. 7 of Italian Legislative Decree 196/03, within the times and by the procedures envisaged by the law, and to obtain the full, up-to-date list of any other data processors, is the Information Systems and Process Organisation Manager, who can be contacted for the purposes of this role at the Company’s addresses and by email on infoprivacy@illy.com (all communications must be addressed “to the Data Processor”. Any changes in the data processor will appear in the website’s privacy policy. 
6.	The Company will conserve and use the data for a period appropriate to the purposes for which they are used and compliant with the relevant legal requirements. 
7.	You may exercise your rights under art. 7 of Italian Legislative Decree 196/2003, as stated below, at any moment, in accordance with the statutory times and procedures: 

1.	A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form. 
2.	A data subject shall have the right to be informed 
a)	of the source of the personal data; 
b)	of the purposes and methods of the processing; 
c)	of the logic applied to the processing, if the latter is carried out with the help of electronic means; 19 
d)	of the identification data concerning data controller, data processors and the representative designated as per Section 5(2); 
e)	of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing. 
3.	A data subject shall have the right to obtain 
a)	updating, rectification or, where interested therein, integration of the data; 
b)	erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; 
c)	certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. 
4.	A data subject shall have the right to object, in whole or in part, 
a)	on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; 
b)	to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.

Informativa ai sensi dell’art. 13 del D.lgs 196/03 

La informiamo che, per le finalità di seguito indicate, illycaffè S.p.A. (di seguito anche “la Società” o “ilycaffè”) sarà in possesso di alcuni dati personali da Lei stesso eventualmente conferiti. 
1.	I dati di cui all’oggetto saranno trattati dalla società in modalità manuale cartacea e telematica, al fine di consentire la Sua iscrizione al portale…………….; per poter usufruire di tutti i servizi in esso contenuti e specificati nella Editorial policy e nei Terms e Conditions; per tutte le finalità contenute e specificate nella Editorial policy e nei Terms e Conditions, non che per tutte le finalità connesse alla gestione del portale stesso e dell’iniziativa SustainArt da parte di illycaffè. 
I dati potranno poi sempre essere trattati dalla società per finalità relative all’adempimento di ogni obbligo di legge regolamenti e normative comunitarie e per far valere o difendere un diritto della società. 
La società effettuerà sui dati le sole operazioni necessarie al perseguimento delle finalità indicate in tale informativa.
Specifiche misure di sicurezza sono osservate dalla società per prevenire la perdita dei dati, usi illeciti o non corretti ed accessi non autorizzati. Il trattamento avverrà da parte della società con logiche strettamente correlate alle finalità indicate nella presente informativa e i dati saranno organizzati da illycaffè anche in banche dati (anche informatiche).
I dati saranno conservati presso le sedi di illycaffè S.p.A. e presso i responsabili del trattamento nominati (oltre che presso terzi a cui i dati vengano comunicati come specificato nella presente informativa).
2.	Per quanto attiene alla comunicazione e diffusione dei dati, i dati saranno visibili nell’area privata del portale e quindi comunicati dalla società ai curatori o critici (qualora si iscriva col profilo artista) e agli altri artisti e curatori e critici (qualora si iscriva col profilo curatore o critico). Saranno visibili e quindi comunicati il Suo nome, cognome e-mail e indirizzo sia nel caso in cui si iscriva come artista, sia nel caso in cui si iscriva come critico o curatore. Inoltre l’artista potrà rendere visibili facoltativamente altri dati contenenti informazioni, foto, biografie ecc. 
Nel caso poi Lei si iscriva col profilo di artista e il Panel decida di pubblicare il Suo lavoro nell’area pubblica o di mostrare il lavoro in una mostra reale, alcuni Suoi dati (nome e cognome, anno di nascita, e luogo di residenza, appartenenza del lavoro) saranno diffusi attraverso il portale www.illysustainArt.org e attraverso ogni altro materiale promozionale e mezzo di comunicazione.
Saranno poi anche diffusi attraverso il portale e ogni altro materiale promozionale e mezzo di comunicazione il Suo nome e cognome qualora si sia iscritto come curatore o critico e sia curatore o critico di un lavoro soggetto a pubblicazione o mostra.
I dati potranno poi sempre essere comunicati da illycaffè S.p.A. a organi pubblici e di polizia qualora sussista un obbligo a tale comunicazione e a legali e a poste o vettori-spedizionieri qualora comunicazioni o materiale siano inviati attraverso posta.
Potranno poi trattare i dati (e quindi conoscere i dati stessi in qualità di incaricati al trattamento dei dati), se necessario, tutti gli incaricati (personale amministrativo, soci, tecnici informatici anche esterni, personale anche esterno addetto ai rapporti con il pubblico, addetti marketing anche esterni, personale dei sistemi informativi anche esterni, addetti all’iniziativa e alla sua promozione anche esterni, addetti alla gestione del sito anche esterni, addetti alle pratiche legali anche esterni, consulenti esterni- legali, informatici, addetti alla qualità- addetti all’imbustamento e alle spedizioni anche esterni) al trattamento (nominati ai sensi di legge dalla società) secondo i loro livelli e profili di autorizzazione. Potranno inoltre averne conoscenza eventuali responsabili del trattamento dei dati interni e anche esterni (quali società di consulenza marketing, outsourcer informatici che conservano i dati nei loro server o effettuano manutenzione dei sistemi informatici e società incaricate alla gestione dell’iniziativa e del sito, società addette al call center, società addette all’imbustamento e alle spedizioni) sempre nominati dalla società. Anche i responsabili del trattamento tratteranno i dati solo se necessario allo svolgimento dei compiti assegnati dalla società compiendo sui dati le sole operazioni necessarie allo svolgimento di tali compiti. Le società-soggetti esterni/e nominate/i responsabili del trattamento tratteranno i dati o direttamente  o attraverso loro collaboratori incaricati al trattamento per conto di illycaffè che svolgeranno le stesse attività che svolgono tali società/soggetti esterni per conto di illycaffè.
3.	Il conferimento dei dati segnati in grassetto nel form di registrazione è necessario al fine di poter dare seguito all’iscrizione e per tutte le finalità di cui al punto 1. Il mancato conferimento comporterà l’impossibilità di dar seguito all’iscrizione e/o di poter poi gestire la partecipazione all’iniziativa SustainArt. Il mancato conferimento dei dati invece non in grassetto nel form di registrazione e di altri dati eventualmente richiesti (ad eccezione ovviamente di quelli in grassetto nel form di registrazione), comporterà la sola conseguenza di non utilizzare tali dati (che possono essere utili per fornire un miglior servizio e per meglio promuovere l’artista) e pertanto il conferimento è facoltativo e il mancato conferimento non avrà conseguenze sulla possibilità di iscriversi all’inziativa.
4.	Titolare del trattamento è la scrivente società illycaffè S.p.A. con sede in via Flavia 110 a Trieste tel. +39.040.3890.111, fax +39.040.3890.490.
5.	Il Responsabile del trattamento a cui la S.V. si potrà rivolgere per l’esercizio nei tempi e nei modi previsti dalla legge, dei diritti di cui all’art. 7 del D.lgs 196/03 e inoltre per ottenere la lista completa e aggiornata di altri eventuali responsabili (ogni comunicazione dovrà essere indirizzata “alla c.a. del responsabile del trattamento dei dati) è il Direttore dei Sistemi Informativi e Organizzazione Processi reperibile per la presente carica agli indirizzi della società e alla e-mail infoprivacy@illy.com . Eventuali cambiamenti di responsabile saranno comunicati nella policy privacy del sito. 
6.	I dati verranno conservati e trattati dalla società per un periodo conforme alle finalità per le quali vengono trattati e conforme alle vigenti normative. 
7.	Potrà in qualsiasi momento esercitare, nei tempi e nelle modalità previsti dalla legge, i diritti di cui all’art. 7 del D.Lgs. 196/03 che riportiamo qui di seguito:
1.	L'interessato ha diritto di ottenere la conferma dell'esistenza o meno di dati personali che lo riguardano, anche se non ancora registrati, e la loro comunicazione in forma intelligibile.
2.	L'interessato ha diritto di ottenere l'indicazione:
a)	dell'origine dei dati personali;
b)	delle finalità e modalità del trattamento;
c)	della logica applicata in caso di trattamento effettuato con l'ausilio di strumenti elettronici;
d)	degli estremi identificativi del titolare, dei responsabili e del rappresentante designato ai  sensi dell'articolo 5, comma 2;
e)	dei soggetti o delle categorie di soggetti ai quali i dati personali possono essere comunicati o che possono venirne a conoscenza in qualità di rappresentante designato nel territorio dello Stato, di responsabili o incaricati.
3.	L'interessato ha diritto di ottenere:
a)	l'aggiornamento, la rettificazione ovvero, quando vi ha interesse, l'integrazione dei dati;
b)	la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati;
c)	l'attestazione che le operazioni di cui alle lettere a) e b) sono state portate a conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto tutelato.
4.	L'interessato ha diritto di opporsi, in tutto o in parte:
a)	per motivi legittimi al trattamento dei dati personali che lo riguardano, ancorché pertinenti allo scopo della raccolta;
b)	al trattamento di dati personali che lo riguardano a fini di invio di materiale pubblicitario o di vendita diretta o per il compimento di ricerche di mercato o di comunicazione commerciale.
